SNIA Trace Data Files Contributor License

The following are the licensing terms for contributing I/O Trace Data files to the IOTTA Repository.  These licensing terms must be accepted in order to contribute I/O Trace Data files for inclusion within the IOTTA Repository:

Trace Tools and Data Files Contributor License

The person, company, or entity ("Contributor") signing below hereby contributes the accompanying trace tools and/or trace data files and associated documentation ("Contribution") to SNIA, subject to the following terms.

  1. Copyright License.
    1. If the contribution is contributed with any license approved by the Open Source Initiative (OSI – www.opensource.org/licenses), then Contributor hereby grants to SNIA a copyright license in the Contribution in accordance with and subject to the terms of said open source license.
    2. If the contribution is contributed with any license not approved by the Open Source Initiative, then Contributor hereby grants to SNIA a non-exclusive, irrevocable, worldwide, no-charge, transferable license under its copyrights to deal in the Contribution without restriction, including, without limitation, the rights to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the Contribution, and to permit persons to whom the Contribution is furnished to do so. Contributor retains its copyrights in the Contribution and does not hereby assign or transfer any copyrights to SNIA.
  2. Contributor represents that Contributor is legally entitled to grant the above license.
  3. Contributor represents that the Contribution does not contain confidential or proprietary information.
  4. CONTRIBUTIONS ARE PROVIDED "AS-IS," WITH ALL FAULTS, DEFECTS AND ERRORS, WITHOUT WARRANTY OF ANY KIND, EXPRESS, OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
  5. IN NO EVENT SHALL SNIA OR CONTRIBUTOR BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE CONTRIBUTION OR THE USE OR OTHER DEALINGS IN THE CONTRIBUTION.
